Terms & Conditions
These terms are important and they apply upon acceptance by Burgundy Cave Limited on any orders placed via email, phone or online by the Customer. Once incorporated they will continue to apply to all future transactions unless and until modified by written agreement between Burgundy Cave Limited and the Customer.
A contract for sale incorporating these terms comes into existence when we expressly accept your order. The contract is conditional upon wines not having been previously sold by us and we will notify you without delay should this occur.
(A) For items sold in the “Current In Stock” section on the Website:
“Current In Stock” items refer to all goods that are currently available in Hong Kong and ready to be delivered once payment has been settled by the Customer to Burgundy Cave Limited. Full payment is required before goods will be arranged for delivery. Once the order has been made either via phone or email, the payment has to be settled within 3 days upon receiving the invoice from Burgundy Cave Limited; or immediately via our online credit card payment system. Once Burgundy Cave Limited confirms receipt of payment, we will inform the Customer by issuing an Acceptance of Order. We reserve the right to claim administration charge or any charge taken by the bank for any late payment which is settled after 3 days of placing order.
(B) For items sold in the “Broking List” section on the Website or any brokerage items:
“Broking List” items / Brokerage items refer to all goods that are not lying locally and includes goods that are lying in Burgundy Cave Limited’s Europe cellar, suppliers’ warehouses or wineries. A deposit has to be completed before order confirmation. The deposit is 70% of the total invoice amount and 30% remaining balance has to be settled before delivery. Once the order has been made either by phone, Website or email, we will issue an Invoice as an Acceptance of Order and the payment has to be settled within 3 days to confirm the order. We reserve the rights to claim administration charge or any charge taken by the bank for any late payment which is settled after 3 days of placing order.
Delivery of goods
We offer free-of-charge local delivery for purchases over HKD3,000 or 6 bottles (delivery to one address only).
For orders under HKD3,000 and for orders at any amount requiring delivery to Outlying Islands, a delivery charge of HKD80 per delivery address shall apply. We will confirm the delivery date and time with the Customer within 2 working days after the order has been confirmed for Stock Items; and as soon as ETA is confirmed for Broking items. If goods are not collected or delivered within three months after payment for stock items or after arrive for Broking items, Burgundy Cave Limited will be entitled to charge a storage and administration fee (HKD200 per case per month).
Acceptance of goods
It is your obligation to inspect goods immediately upon receipt and notify our company of any shortage or damage no later than 2 days after the delivery. The absence of any notification within two days the shortage, damage or any other deficiency will be deemed to have occurred after delivery to you.
We accept payment by Credit Card (VISA, MasterCard, AmericanExpress, UnionPay) via the PayPal online payment system. All product prices are sold in HK dollars. For all wine orders made by phone, Website or email, it shall be subjected to Burgundy Cave Limited sole discretion and may not be accepted due to the availability of stock.
Quality and Attributes
We make every effort to ensure the wines we sell are stored properly with a standardized quality of storage. However, we cannot be responsible for the condition of wine or whether the wine show any attributes which is expected. We do not guarantee taste or drinkability of wines purchased because drinkability and taste are subjective judgments. With respect to older or high-value wines we will make reasonable efforts to verify the provenance of such wines but we cannot guarantee the authenticity or quality of the wine in the bottle. Opinions as to authenticity and provenance will vary and in many cases even following scientific testing and detailed research it is not possible to establish the authenticity or provenance of a given wine definitively. Given the nature of the wines we sell, we do not provide refunds for corked wines.
We will not be liable for any indirect or consequential losses or damages including lost bargain, lost profit, lost reputation, loss of anticipated savings.
We shall not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.
Cancellation of order
You will have a right to cancel your contract for the purchase of wines if it does not incur any loss to Burgundy Cave Limited. We will make the reimbursement using the same means of payment as you used for the initial transaction, we are not liable to any loss due to financial and administrative charge during reimbursement. If the cancellation of order incurs loss to Burgundy Cave Limited, we reserve the right to reject your order cancellation request.
